Man charged with homicide in ATV crash

BLACK RIVER FALLS — A vehicular homicide charge was filed Tuesday against a 23-year-old accused of driving drunk when he struck and killed a woman riding an ATV on Saturday in the town of Knapp.

Phillip Holloway of Warrens was charged with homicide by intoxicated use of a vehicle, operating while intoxicated causing injury and operating a motor vehicle while intoxicated-second offense in the death of Karen Gibson of Brodhead, Wis.

Holloway told authorities he was driving about 40 mph on a curve on Fish Creek Road at Hwy. O about 4:15 p.m. when he saw “a lady on a four-wheeler driving down the middle of the road,” according to the criminal complaint filed in Jackson County Circuit Court.

He slammed on his brakes but said “the lady was looking behind her and never saw him,” the complaint stated.

The collision threw a 3-year-old girl from the four-wheeler onto the hood of his car, according to the complaint. He found Gibson under his vehicle and called 911 after failing to find a pulse.

Gibson was pronounced dead at the scene. The child was treated for scrapes on her left leg.

Holloway said he had consumed four or five beers between 12:30 and 3 p.m., the complaint stated. He registered a 0.14 percent preliminary breath test.

Holloway was convicted in Monroe County in July 2005 of driving with a prohibited alcohol concentration. He was charged in June with drunken driving, also in Monroe County. A motion hearing is set for Sept. 30.

His record in Wisconsin also includes convictions for underage drinking, failure to wear a seatbelt and inattentive driving, according to online court records.

Holloway was released from custody Tuesday after posting his $10,000 cash bond. He is due back in court Tuesday.
